lg This case is on remand from the United States Court of Appeals for the Ninth
20 Circuit. On December 3, 2007, the Ninth Circuit issued an Opinion and a Judgment
21 reversing this Court’s March 24, 2005 order granting p1aintiffs’ motion for summary
22 judgment (dlrt. no. 32), and this Court’s May 18, 2005 judgment for plaintiffs (dkt. no. 34).
23 The Ninth Circuit’s Judgment was filed in this Court on January 31, 2008 (dkt. no. 38).
24 This case soughtjudicial review of Department of Health and Human Services
25 Departmental Appeals Board Decisions Nos. 1779 and 1792 pursuant to the Administrative
26 Procedure Act. At the time the Court issued the decision that has been reversed, the case
27 was before this Court on the parties' cross-motions for summaryjudgment, the usual
28 procedure for adjudicating the merits in such a case.

1 The Ninth Circuit reversed this Court’s order reversing Departmental Appeals Board
2 Decisions Nos. 1779 and 1792, and remanded for proceedings consistent with its ruling,
3 The parties are in agreement that there are no remaining issues to be resolved and that the
4 Ninth Circuit’s decision compels entry ofjudgment in favor of defendants and upholding
5 Departmental Appeals Board Decisions Nos. 1779 and 1792.
6 Therefore, the parties stipulate that finaljudgment should be entered in favor of
7 defendants Centers for Medicare and Medicaid Services et al. and against plaintiffs
8 Arizona Health Care Cost Containment System et al. on all claims, dismissing the
9 Complaint and action and that each party shall bear its own costs and attorneys’ fees.
10 A proposed order is submitted herewith.
11 I, Michael A. Johns, by signing below, certify pursuant to the District of
12 Arizona ECF Administrative Policies and Procedures Manual, that the content ofthis
13 Stipulation is acceptable to all registered signatories required to sign it.
