The court’s records indicate that this appeal was tiled during the pendency
of a timely-tiled Fed. R. App. P. 4(a)(4) motion. The notice of appeal is therefore
ineffective until entry of the order disposing of the last such motion outstanding.
See Fed. R. App. P. 4(a)(4). Accordingly, proceedings in this court shall be held
in abeyance pending the district court’s resolution of the pending August 8, 2005
motion. See Leader Nat? Ins. C0. v. Industrial Indemnity Ins. C0., 19 F.§d 444
(9th Cir. 1994). Within 7 days of the district court’s ruling on the pending August
8, 2005 motion, appellant shall notify this court in writing of the ruling and
whether he intends to prosecute this appeal. Appellant shall further note whether
he wishes to amend the notice of appeal to include the district court’s ruling on the
post-judgment motion. See Fed. R. App. P. 4(a)(4). i
