16 Service; and Yvonne Pearson, separately and in her individual capacity, by the undersigned, and 17 respectfully request that this Court continue its oral argument on all pending matters currently 18 scheduled for June 21, 2006 to a date after Friday, July 7, 2006. In support of which, Defendants 19 state as follows: 20 1. On April 26, 2006, this Court scheduled oral argument on all pending matters in 21 the above-captioned cause for June 21, 2006 at 3:30 p.m. [Doc. No. 196]. 22 2. Defense counsel Peter M. Lantka recently relocated to the United States Attorney's 23 Office from the State of Indiana, and is scheduled to move his household to Arizona during the 24 week of June 19, 2006. 25 3. The undersigned contacted counsel for the Plaintiff on April 26, 2006 and received 26 no objection to a proposed continuance. Plaintiff counsel's schedule is amenable to oral 27 argument following the July 4 holiday weekend. 28

This motion constitutes the United States' first request for continuance of oral

2 argument. LR Civ 7.3(a). 3 4 5 5. 6. This motion is not being made for purposes of harassment or undue delay. A proposed Order is lodged with this motion.
