Pending further order of this court, you shall withhold and retain on a continuing basis 25% of the defendant judgment debtor's non-exempt earnings, if any, as you determine in accordance with the Non-Exempt Earnings Statement form attached to the Answer of Garnishee form provided you. Please state whether or not you anticipate paying the debtor any future payments and whether such payments are weekly, bi-weekly, monthly, or otherwise. You must file the original written answer to this writ within ten days of your receipt of this writ with the United States District Clerk at: 401 West Washington Street, SPC 1, Phoenix, Arizona 85003-2118. Additionally, you are required by law to serve a copy of your answer upon the debtor at: 400 W. Baseline Road Lot 136, Tempe, Arizona 85283-1131, and upon the United States Attorney at Financial Litigation Unit, 405 W. Congress, #4900, Tucson, Arizona 85701-5041. Under the law, there are disposable earnings which are exempt from this writ of Garnishment. Pursuant to 15 U.S.C. ยง1674, Garnishee is prohibited from discharging the defendant from employment by reason of the fact that his earnings have been subject to garnishment for any one indebtedness. If you fail to answer this writ or withhold property in accordance with this writ, the United States of America may petition the Court for an order requiring you to appear before the Court. If you fail to appear or do appear and fail to show good cause why you failed to comply with this writ, the Court may enter a judgment against you for the value of the debtor's non-exempt property.
