Defendant, Nolan Smith, through undersigned counsel, asks this Court to continue the admit/deny hearing set for June 26, 2006, for a period of 30 days. The reason for the requested continuance is that counsel will be out of state from June 19 through July 6, 2006. Counsel will also be on medical leave from July 13 through July 17. Mr. Smith also request that the disposition hearing be held the same date as the admit/deny hearing. Defense counsel has contacted the Assistant U.S. Attorney assigned to this case, Darcy Cerow, who has no objection to this motion. Excludable delay under 18 U.S.C. ยง 3161(h)(1)(F) and (8)(A) will occur as a result of this motion or from an order based thereon.
