Petition to Revoke Supervised Release ( Z S
COMES NOW PROBATION OFFICER Josephine Begay presenting an official report on Nolan
Jacob Smith who was committed to the Bureau of Prisons on September 8, 2004, by the Honorable Paul
G. Rosenblatt presiding in the District Court of Arizona. A two year period of supervised release was
imposed, and supervision commenced upon the offenders discharge from imprisonmenton May2, 2005.
In addition to the general terms and conditions adopted by the court in General Order 05-36, the offender
was ordered to comply with the following special conditions:
1. You shall participate as instructed by the probation officer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost of
treatment in an amount to be determined by the probation officer.
2. You shall submit your person, property (including but not limited to computer, electronic devices,
and storage media), residence, office, or vehicle to a search conducted by a probation officer, at
a reasonable time and in a reasonable manner.
3. You shall abstain from all use of alcohol or alcoholic beverages.
On September 20, 2005, Smith's supervision was modified to include the following:
4. You shall reside and participate in a community corrections center for 180 days, unless
discharged earlier by the probation officer.
Nolan Jacob Smith was convicted of Escape from Custody, in violation of 18 U.S.C. §751(a), a class
D felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A, Violation of Special Condition #3: You shall abstain from all use of alcohol or alcoholic
beverages.
On January 23, 2006, Smith consumed alcohol. Grade C violation. 7B1 .1(a)(3).
B. Violation of Special Condition #4 You shall reside and participate in a community corrections
center for up to 180 days, unless discharged earlier by the probation officer.
On February 23, 2006, Smith left Behavioral Systems Southwest and his whereabouts is
unknown. Grade C violation. 7B1.1(a)(3)

I find there is probable cause to believe the offender has violated conditions of supervision, supported
