15 Comes now, the United States, by and through undersigned attorney, and requests that
16 the warrant issued in this case be quashed and the indictment in this case be dismissed against
17 the above listed defendant, without prejudice.
18 The defendant failed to appear for a status hearing in October of 2004, and it was learned
19 that he fled back to Mexico. There is no further investigation in this case and since the
20 government does not know his whereabouts, dismissing the case would be in the best interests
21 of justice.
