Appel1ant’s motion to proceed in forma pauperis is granted.
The motion of Mark J. Berardoni, Esq. 45 West Jefferson, Suite 810,
Phoenix, Arizona 85003, (602) 257-1295, for leave to withdraw as counsel is
granted.
Appe11ant's motion for appointment of counsel is granted. Counsel will be
appointed by separate order. .
The Clerk shall serve a copy of this order on_ Ion M. Sands, Federal Public _
Defender, 850 West Adams Street, Suite 201, Phoenix, Arizona 85007, who will l
locate appointed counsel. The district court shall provide the Clerk of this court
with the name and address of appointed counsel by facsimile transmission (FAX:
(415) 556-6228) within 14 days of locating counsel. h
New counsel shall designate the reporter’s transcript by October 16, 2006.
The transcript is due November 15, 2006. Appe1lant’s opening brief and excerpts
of record are due December 26, 2006; appellee’s answering brief is due January

25, 2007; and the optional reply brief is due within 14 days after service of the
_ answering brief. .
The Clerk shall also serve a CJA Form 24 and a certified copy of this order
on Mr. Sands who shall provide them to newly appointed counsel. See 28 U.S.C.
§ 753(t`). If appellant is seeking transcripts of proceedings requiring special
authorization, that authorization should be obtained from the district court. See VI

Upon filing the transcripts, the court reporter shall submit the CJA Form 24
to this court for payment. _
The Clerk shall amend the docket to reilect appellant’s pauper status.
The Clerk shall serve this order on former counsel.
