CR 04-00675-6-PHX-JAT ORDER (First Request) SEALED CASE

Upon motion of the defendant, Government having no objection, and good cause appearing, to wit: additional time needed for investigation and pretrial preparation, IT IS HERBY ORDERED granting Defendant's Motion for Extension of Time to File Pretrial Motions and to Continue Trial. The Court finds that the ends of justice served by granting a continuance outweigh the best interests of the public and the defendant in a speedy trial. This Court specifically finds that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(B)(iv). IT IS ORDERED continuing the trial from August 1, 2006 to October 3, 2006 at 9:00 a.m. as to defendant Wahl (06). IT IS FURTHER ORDERED extending the time to file pretrial motions to August 18, 2006 pursuant to Rule 12(b), Fed. R. Crim. P.

IT IS FURTHER ORDERED vacating status hearing set for July 19, 2006 at 4:00

IT IS FURTHER ORDERED that excludable delay under Title 18 U.S.C. §3161(h)(8)(A) and (B) will commence on 8/2/06 through 10/3/06, for a total of 62 days. This being a sealed case, IT IS ORDERED that Defendant's Motion for Extension of Time to File Pretrial Motions and to Continue Trial and this Order be filed under seal.
