It is expected that excludable delay pursuant to 18 U.S.C. § 3 161(h)(1)(F) may will as

a result of this motion.

COMES NOW, the Defendant, RAMON YANEZ-AGUTRRE, by and through his
17
attorney undersigned, and hereby moves this court for a continuance of the Sentencing
18
Hearing currently scheduled for January 17, 2006 at 3:00 p.m. for a period of no less than 30
19
days for the following reasons:
20
1. Counsel for Defendant, Ramiro Flores, will be in Detroit Michigan from January
21
17-19, 2006, in re: the matter of State of Michigan vs. Rigoberto Cardenas-Borbon, due to
22
the amount of co-defendants in this matter it cannot be continued;.
23
2. Assistant U.S. Attorney, Brian Larson, has been advised of this request and
24
expresses no objection to this continuance.
25
WHEREFORE, defendant respectfully request that the court continue the sentence
26
hearing scheduled on January 17, 2006 at 3:00 p.m.
27
This request is made in good faith and not for purposes of unnecessary delay.
