Appellant’s motion to withdraw appeal if in forma pauperis status is not
granted is construed as a late motion for leave rb proceed in forma pauperis. So
construed, the motion is granted. The Clerk shall amend the docket to reflect that
appellant is proceeding on appeal in forma pauperis. ·
The motion of Anders Rosenquist, Jr., Esq., 80 East Columbus, Phoenix,
Arizona 85012, (480) 488-0102, to withdraw al retained counsel for appellant is

granted. Counsel will be appointed by separate order.
The Clerk shall serve a copy of this order on Jon M. Sands, Federal Public
_ Defender, 850 West Adams Street, Suite 201, Hhoenix, Arizona 85007, who will
locate appointed counsel. The district court shelll provide the Clerk of this court

with the name and address of appointed counsei by facsimile transmission (FAX:
(415) 355-8111) within 14 days oflocating counsel.
New counsel shall designate the reporteris transcript by May 15, 2008. The
transcript is due June 16, 2008. Appellant’s opening brief and excerpts of record
are due July 28, 2008; appellee’s answering briif is due August 27, 2008; and the 1
optional reply brief is due within 14 days after service of the answering brief.
The Clerk shall also serve a CJA Form 24 and a certified copy of this order
on Mr. Sands, who shall provide them to newlyappointed counsel. See 28 U.S.C.
§ 753(f). If appellant is seeking transcripts of proceedings requiring special
authorization, that authorization should be obtained from the district court. See VI
Guide to Judiciary Policies & Procedures § l3.6.l.b.(2)(a)-(g).
Upon filing the transcripts, the court reporter shall submit the CJA Form 24
to this court for payment.
