Appellant’s motion for leave to proceed in forma pauperis and for
appointment of counsel is denied without prejudice to renewal, accompanied by a
completed financial affidavit (CIA Form 23), if the defendant is financially unable
to obtain representation on appeal. See 9th Cir. R. 4-1(c).
Within 21 days after the date of this order, appellant’s retained counsel,
Anders V. Rosenquist, Esq., shall: (1) make the necessary arrangements to pay the
docketing and filing fees of $45 5.00 to the clerk of the district court and provide
proof of payment to this court; or (2) move this court for leave to proceed on
appeal in forma pauperis accompanied by a completed financial affidavit (CIA
Fonn 23).

Counsel Rosenquist has the duty to continue to represent appellant until s
relieved by this court. See 9th Cir. R. 4-l(a). Failure to submit a timely renewed
motion or to prosecute this appeal may subject counsel to the imposition of
sanctions. _
In the absence of the filing of a renewed motion, the opening brief and 8
excerpts of record are due March 3, 2008; the answering brief is due April 2, 2008;
andthe optional reply brief is due within 14 days after service of the answering
brief. ‘
The Clerk shall serve this order and a CJA Form 23 on counsel Rosenquist.
