CR 04-01034-01-PHX-FJM ORDER

Upon defense Motion to Continue Trial (6th), Government not objecting, and good cause appearing, IT IS ORDERED granting Defendants' Motion to Continue the trial date of 1/4/2006 and resetting trial on 2/7/2006 at 9:00 a.m., in , Arizona. The Court finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial. This finding is based upon the court's conclusion that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking in account the exercise of due diligence. 18 U.S.C. §3161(h)(8)(B)(iv). Excludable delay under 18 U.S.C. §3161(h)(8)(A) is found to commence on 1/5/2006 for a total of 33days. DATED: 12/13/2005
