At the request of Defendant, the Government not objecting, and supported by good cause because defendant needs additional time to complete discovery and prepare for trial, IT IS ORDERED granting Defendant's Motion to Continue the trial date of November 1, 2005 and resetting trial on 1/4/2006 at 9:00 a.m.. The Court finds that the ends of justice served by granting a continuance outweigh the best interest of the public and the defendant in a speedy trial. This finding is based upon the court's conclusion that the failure to grant such a continuance would deny the defendant the reasonable time necessary for effective preparation, taking in account the exercise of due diligence. §3161(h)(8)(B)(iv). IT IS FURTHER ORDERED continuing the pretrial motion deadline to 12/9/2005. Excludable delay under 18 U.S.C. §3161(h)(8)(A) is found to commence on 11/2/2005 for a total of 63 days.
