Case No. CR04-1065-PHX-DGC
ORDER
Upon motion of the defendant and good cause appearing, IT IS HEREBY ORDERED
17 that the defendant's Motion to Continue Trial is granted pursuant to 18 U.S.C. §3161 18 (h)(8)(A).
This court specifically finds that the ends of justice served by granting a
19 continuance outweigh the best interest of the public and the defendant in a speedy trial. This 20 finding is based on the court's conclusion that the failure to grant such a continuance would 21 unreasonably deny the defendant the reasonable time necessary for effective preparation, 22 taking in to account the exercise of due diligence. 23 18 U.S.C. §3161(h)(8)(b)(IV). 24
IT IS FURTHER ORDERED continuing the trial of this case from November 8, 2005,
25 to January 10, 2005, at 9:00 a.m., in Phoenix, Arizona. 26 27 28
