MOTION FOR UNSEALING PLEA COLLOQUY TRANSCRIPT RECORD
AND SENTENCING HEARING TRANSCRIPT RECORD OF PAUL JIMENEZ
UNDER RULE 6 FOR DISCOVERY, PURSUANT TO SPECIAL GOVERNING
PETITION TO VACATE, AMEND OR CORRECT SENTENCE UNDER 28 U.S.C.§2255
COMES NOW, the above defendant Calvin Frank Morris in pro se
capacity, respectfully before this Honorable District Court on Motion
for Unsealing Plea Colloquy and Sentencing Hearing Transcripts Record
of Paul Jimenez, under Discovery Rule 6, of Special Governing Rules
of 28 U.S.C. §2255, and in support thereof provides the following;
1. Under the Special Rules Governing §2255, Rule 6, a judge may,
for good cause, authorize a party to conduct discovery under the
Federal Rules of Criminal Procedure or Civil Procedure, or in accord-
ance with practices and principles of law.
2. In the particular case, herein, the defendant Calvin Frank Morris
request that the Honorable Court exercise its authority to provide him
access to the plea colloquy and sentencing hearing records of Paul
Jimenez, defendant's co—defendant.
3. The Defendant is in need of the specific information which
reference the drug amount Jimenez plea guilty of conspiring to posse-
ss and the'drug amount the government offered proof in corroboration
of Jimenez s plea. The Defendant did seek the Government's assistance
with this matter on 26 April 2007, however, to no avail because the
government has yet to respond. ‘

4. The Defendant needs this information because of its support
of his claim, which he intends to raise on §2255, that the Govern-
ment impermissibly amended the indictment upon which Defendant was
charged by changing its theory of the case during trial.
5. However, presently Jimenez's plea colloquy transcript record
and sentencing transcript record are sealed, and Defendant is barred
because of that sealing from retrieving the records.
6. Therefore, the Defendant cannot receive the same without the
Honorable Court, first, ordering.) the same be unsealed, even just
temporarily.

essential to their habeas petition. See e.g.Bracy v Gramley, 520
U.S. 899, 908-09, 117 S. Ct. 1793, 138 L.Ed2d 97 (1997); Harris v
Nelson, 394 U.S. 286, 300, 89 S.Ct. 1082, 22 L.Ed2d 281 (1969);
Jones v Wood, 114 F3d 1002, 1009 (9th Cir. 1997) and Pham v Terhune,
400 F3d 740 (9th Cir. 2005).
WHEREFORE, based upon the forementioned statements and legal
citations of law, the defendant prays that this motion will be granted,
as well as, any other relief deem appropriate and fair, Accordingly.
