Sentence.

Pursuant to LRCiv 83.3(c)(2), since defendant is represented by counsel, all

contacts with the Court must be made through counsel. Additionally, the Court notes that

appeal is pending before the Ninth Circuit Court of Appeals.

IT IS ORDERED denying defendant's pro se motion without prejudice to

defendant's counsel filing a motion as deemed appropriate.
