Defendant, through counsel, moves this Court continue the admit / deny hearing scheduled for October 7, 2005, at 3:00 a.m. Defendant makes this request because each of the alleged supervised release violations are criminal offenses. Mr. Wirth, Jr., believes that all of the l offenses will be dismissed. Thus, possibly negating the petition to revoke supervised release. Mr. Wirth, Jr.'s counsel in Flagstaff continued that matter for 30-days. Mr. Wirth, Jr., would like to see if the respective cases can be reconciled, or resolve the Flagstaff matter before addressing the admission /denial of this case. Therefore, Mr. Wirth, Jr., requests this Court continue the admit / deny hearing for 30-day. Counsel for Mr. Wirth, Jr., consulted with government's counsel, Darcy Cerow, regarding this request. Ms. Cerow has no objection.
