Petition to Revoke Supervised Release
COMES NOW PROBATION OFFICER James P. Barquin presenting an official report on Robert
Wirth Jr. who was committed to the Bureau of Prisons on December 19, 1997, by the Honorable Barbara
B. Crabb presiding inthe U.S. District Court, Western District of Wisconsin. A 60 month and 36 month ‘
period of supervised release was imposed respectively on Counts 1 and 2. The supervised release
terms were to be served concurrently and supervision commenced upon the offender's discharge from
imprisonment on July 3, 2003. On January 27, 2005, the Court reinstated supervised release for a period
of 48 months on Count 1 and 36 months on Count 2, to run concurrently. In addition to the standard
conditions adopted in General Order 04-11, the following special conditions were imposed:
1. You shall pay remaining restitution balance in monthly installments as directed by the probation
officer.
2. You shall participate as instructed by the probation ofhcer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost of
treatment in an amount to be determined by the probation officer.
3. You shall submit your person, property (including but not limited to computer, electronic devices,
and storage media), residence, office, or vehicle to a search conducted by a probation officer, at
a reasonable time and in a reasonable manner.
4. You shall provide the probation officer access to any requested financial information.
5. You shall participate in a mental health program as directed by the probation officer which may
include taking prescribed medication. You shall contribute to the cost of treatment in an amount
to be determined by the probation officer.
6. You shall abstain from all use of alcohol or alcoholic beverages.
Robert Wirth Jr. was convicted of Count 1 , Armed Bank Robbery, 18 USC 21 13(a) and (cl); Count 2, Use
of a Firearm During and in Relation to a Crime of Violence, 18 USC 924(c)(1). On November 3, 2004,
jurisdiction was accepted in the District of Arizona. Q

On or about August 4, 2005, Wirth committed the crime of Aggravated Assault, in violation of
A.R.S. 13-1204(A)(3). Grade A Violation, 7B1 .1(a)(1)(A)(i)
B. You shall not commit another federal, state or local crime during the term of supervision.
On or about August 4, 2005, Wirth committed the crime of Burglary (Second Degree), in violation
of A.R.S. 13—1507(A). Grade AViolation, TB1 .1(a)(1)(A)(i)
C. You shall not commit another federal, state or local crime during the term of supervision.
On or about August4, 2005, Wirth committed the crime of Criminal Damage, in violation of A.R.S.
13-1602(A)(1 ). Grade C Violation, 7B1.1(a)(3)(A)
D. You shall not commit another federal, state or local crime during the term of supervision.
On or about August 6, 2005, Wirth committed the crime of Threatening and intimidating, in
violation of A.R.S. 13-1 202(A)(1 ). Grade C Violation, 7B1 .1(a)(3)(A)
E. You shall not commit another federal, state or local crime during the term of supervision.
On or about August 6, 2005, Wirth committed the crime of influencing a Witness, in violation of
A.R.S. 13-2802(A)(1). Grade B Violation, '/B1 .1(a)(2)
