STIPULATION TO EXTEND DEADLINE TO SUPPLEMENT RESPECTIVE STATEMENT OF FACTS IN SUPPORT OF MOTIONS FOR SUMMARY JUDGMENT

The parties, by and through undersigned counsel, hereby stipulate that they be

allowed to submit their respective Supplemental Statement of Facts in Support of
20

Motions for Summary Judgment on or before September 1, 2005. This Court, by minute
21

entry dated July 26, 2005 ordered the parties to supplement their respective Statements of
22

Fact on or before August 15, 2005. Attorneys for both parties have scheduled vacations
23

during this time, therefore, making this deadline impossible to meet. Therefore, the
24

parties stipulate and respectfully request that this honorable Court continue the current
25

date and order that the Supplemental Statements of Fact be filed on or before September
26

1, 2005.
