JOINT MOTION TO AMEND FIRST AND SECOND
JOINT CASE MANAGEMENT PLAN AND CONTINUAN CE
NOW COMES DEFENDANTS, WILLIAM YARNO and JAMES E. LOGAN, and
moves this Honorable Court to grant to said Defendants a continuance with respect to Item l0(a)
(Proposed deadlines for tiling motions to amend pleadings and motions to join additional parties)
originally agreed upon for October 28, 2005 for an additional forty (40) days for the following
reasons:
1. Defendant Yarno resides in south Louisiana (Lafayette) wherein he has experienced
serious problems with respect to the two hurricanes that have devastated a great
portion of south Louisiana causing damage to his office as well as his home which
has caused him to be without his oiiice for a period of three (3) weeks after the
second hurricane.

2. Defendant Logan resides in Broward County, Fort Lauderdale, Florida and he is
currently without power as a result of Hurricane Wilma.
For the foregoing reasons the defendants, WILLIAM YARN O and JAMES E. LOGAN
request that this Honorable Court grant both of the defendants forty (40) days from October 28,
2005 to file amended answers and motions.
