complete the exchange of information required by Fed. R. Civ. P. 26(a)(1). 3. Subjects on which discovery may be needed.

For Plaintiffs: Discovery will be needed on the material allegations in Plaintiffs' claims and any of Defendants' or Defendant-Intervenors' affirmative defenses. Specifically, Plaintiffs anticipate pursuing discovery on the issue of whether the Arizona Citizens Clean Election Act (the "Act") is sufficiently tailored to serve any of Defendants' asserted government interests and whether such interests are legitimate. For Defendants: In addition to the issues Plaintiffs list, Defendants anticipate discovery on the existence and extent of any burden or harm that Plaintiffs claim to have resulted from the Act. The parties do not believe that it is necessary to conduct discovery in phases or to limit or focus discovery upon particular issues. 4. Electronically Stored Information. The parties do not anticipate any

unusual issues regarding the discovery or disclosure of electronically stored information. To the extent that such issues arise, the parties intend to diligently work to resolve them. 5. Protected Material. Plaintiffs anticipate that some information that may

be subject to production may contain sensitive political or financial information, the release and dissemination of which could harm Plaintiffs' interests. In the event that such information is requested and appropriate for production under the Federal Rules of

Civil Procedure, the parties intend to enter into a stipulation and propose a protective order that will limit the dissemination of such information.

The dates for summary judgment assume submission of summary judgment motions on the last day possible under this proposed schedule. In the event such motions are submitted prior to that date, the time periods for filing responses and replies to summary judgment motions under the Federal Rules of Civil Procedure and the District of Arizona local rules shall apply.

Changes in the limitations on discovery. The parties do not at this time

request any changes in the limitations on discovery set forth in the Federal Rules of Civil Procedure. 7. Electronic Service. The parties may serve discovery on any other party

via electronic mail to counsel. Except for materials, documents, and information as to which electronic transmission is impracticable, the parties may respond to any discovery request via electronic mail to counsel. 8. Trial Date. The parties estimate that this case should be ready for trial by

July 13, 2009. The parties anticipate that a trial of this case would require four to eight days. RESPECTFULLY SUBMITTED this 29th day of July, 2008.
