EX PARTE MOTION TO WITHDRAW FROM REPRESENTATION

COMES NOW undersigned counsel, Philip A. Seplow, ex

22 parte, and asks this Court to allow him to withdraw from the 23 representation of James John Hadges, the Plaintiff in the above24 named and numbered case.

Since undertaking Mr. Hadges'

25 representation, undersigned counsel has been working diligently on 26 behalf of Mr. Hadges, and in an effort not to prejudice Mr. 27 Hadges, files this pleading ex parte.

Undersigned counsel does

28 not want to discuss the merits of the case however, it appears as

1 if the Plaintiff and undersigned counsel are at loggerheads about 2 the manner in which the case should be handled.

Undersigned

3 counsel has spent many hours for which he will not be compensated, 4 as well as paying certain costs, but at this point undersigned 5 counsel believes it would be fruitless for him to continue in this 6 manner and matter. 7

Thus, undersigned counsel has filed a Motion with the

8 Court to allow James John Hadges an extra amount of time to answer 9 the Motion for Summary Judgment that has been filed by the 10 defendants, to which the defendants have no objection.

Upon the

11 granting of this Motion to withdraw, undersigned counsel will, at 12 his own expense, send the entire case file to James John Hadges 13 who is now residing in the Arizona Department of Corrections. 14

It is respectfully requested that undersigned counsel be

15 withdrawn from the representation of James John Hadges and that 16 the Plaintiff be granted additional time in which to answer the 17 Motion for Summary Judgment. 18 19 20 21 22 23 24 25 26 27 28
