I Defendants, through counsel undersigned, respectfully request that the Court issue
17 an Order permitting defendants to submit their Reply to Plaintiffs Response to
18 Defendants’ Motion for Summary Judgment on or before September 4, 2007, for the
19 I reasons that: 1) Counsel undersigned is the subject of a pending Motion to Substitute
20 Attomey, tiled August 2, 2007, which is expected to be granted and that will result in his
21 assumption of the defense in this case; 2) Counsel undersigned is leaving for depositions in
22 I California August 15 through August 17, and again on August 22-August 25 and will be
23 I unable to review the case file and prepare a timely Reply without an enlargement of time;
24 3) Counsel undersigned has discussed this request with Plaintiffs counsel who has no
25 I objection to an enlargement of time within which to file the Reply up to and including
26 · September 4, 2007.
