The request for a certificate of appealability is granted with respect to the
following issue: whether appellant is entitled to 90 days statutory tolling under
A Bowen v. Roe, 188 F.3d 1157, 1159 (9th Cir. 1999) after the Arizona State Supreme
Court denied review of his state post-conviction relief petition because a first post-

Arizona, see State v. Smith, l84 Ariz. 456, 458, 910 P.2d l, 3 (1996). See 28 U.S.C.
§ 2253(c)(3). A
Upon review of the record in this appeal, this coiut has determined that the
appointment of counsel in this appeal would benefit the court’s review. The court .
by this order expresses no opinion as to the merits of this appeal. Counsel will be
appointed by separate order.
