8 1. I am an attorney for the Counter-claimant Harlem Globetrotters International, Inc. ("Harlem
9 Globetrotters”) and have personal knowledge of the facts set forth in this affidavit.
10 2. Harlem Globetrotters filed an Answer to Plaintiff Lemon’s Second Affirmative Complaint,
Affirmative Defenses, and Counterclaim in this action on October 25, 2004.

3. Examination of the court files and record in this cause shows that George “Meadowlark"
12 Lemon ("Lemon") was served with a copy of the counter—claim against him, on October 25,
2004.

4. More than 20 days have elapsed since the date on which Lemon was served with a co y of the `

counter—claim.

5. Lemon has failed to answer or otherwise defend as to the October 25, 2004 counter—claim, or
l6 serve a copy of any answer or other defense which he might have had, upon me or Ray K.
17 Harris, attorney of record for Harlem Globetrotters.
18 6. This affidavit is executed by affiant in accordance with Rule 55(a) and (d), for the purpose of
enabling the Harlem Globetrotters to obtain an entry of default against Lemon, for his failure
19 to answer or otherwise defend as to the October 25, 2004 counter-claim.
