Plaintiffs, by and through their undersigned counsel, hereby move this Court to vacate the Final Pretrial Conference in this matter currently set for September

26, 2005, as well as the deadlines for preparation of the Final Pretrial Statement, motions in limine, jury instructions and jury voir dire. Each of the Defendants in this matter has each filed a Motion for Summary Judgment on August 5, 2005, necessarily all three motions will be pending at the time in question and, therefore, Plaintiffs request that the current dates be vacated and that new dates be reset at such time that the Court deposes of the currently pending Motions for Summary Judgment.
