Concurrent with this Motion, defendants, William and Mark Richardson (the

22 "Richardsons") have filed a Motion to Partially Seal the Record. In that motion, the
23 Richardsons argue that two documents in the Court’s file be sealed based upon the offensive
21 language contained therein. The Richardsons have reason to believe that undue publicity

will come to this case on Thursday, October 27, 2005 at a meeting of the governing board of

the Tempe Union High School District and that the Court’s file, including the documents

2 sought to be sealed, may be reviewed as a result of this publicity as early as Friday October
3 28, 2005. Thus, the Richardson request that the Court entertain and grant the accompanying
4 Motion to Partially Seal the Record before October 28, 2005.
