20 I, Mark D. Richardson, declare as follows:
21 1. I understand that the plaintiffs RIEOITLBY has challenged the meaning, of the
22 word "arrangement" as used in my prior declaration.
23 2. I am not a lawyer and do not understand whether there is a legal
24 signiticance of the word "arrangernent." I could have used the words “revise," "edit" or
25 "modify” to cliaxacterize my work on “The Big Apple" (to make it suitable for use by the
26 Corona del Sol Marching Band). Regardless of the words used, the essence of my prior
27 declaration was to express how and when my work on that piece began and progressed.

1 3. It is my understanding, however, that plaintiff has accused me of infringing
2 his copyrights in “The Big Apple" by virtue of any changes that I made to "The Big
3 Apple" so that it would be appropriate for the Corona del Sol Marching Band. I do not
4 believe that anything I did constitutes such an infringement.
5 I declare under penalty of perjury that the foregoing is true and correct.
