Buck,
As you know, there is now the probability that some or all of the settlement agreement will be aired in
public, at the board meeting this Thursday. The potential exists, because the board meetings are
covered by the press, for the press to go digging into the file the next day. On that basis, I would like to
have our stipulation signed and presented to the court, with hopefully an order forthcoming, by Thursday.
This will hopefully have the documents sealed before Friday morning. I recognize that someone may look
earlier or that the Court may not grant the motion and order, but the Richardsons are willing to take that
risk. On the otherside of the coin, the Richardson will seek reversal of any order sealing those
designated portions of the file in the unlikely event of Board does not approve the settlement.
lf I get you a stip by noon tomorrow, will you be in a position to review and sign as appropriate so l can
file on Wednesday?
