Defendant CMS moves this Court to preclude Northland from introducing any evidence pertaining to medical care rendered to Jose Valdez at any time. On January 27, 2006, the Court granted Defendant CMS' Motion for Partial Summary Judgment.

The remaining issues do not relate to the appropriateness of any medical care rendered to Mr. Valdez, expert testimony regarding the care rendered to Mr. Valdez when Mr. Valdez' condition became irreversible, cause of Mr. Valdez' blindness etc. Plaintiff Northland has listed numerous medical exhibits and medical experts

regarding the issue of how and when Mr. Valdez went blind. Originally, both parties anticipated that healthcare providers, treating physicians, medical experts and medical records would be necessary to prove what, if any, affect the care rendered by CMS had on Mr. Valdez' ultimate outcome. The issues pertaining to irreversibility, loss of

vision, standard of care all were issues in the case at the time. Under the present status of the case, all information regarding Mr. Valdez' medical care, comments of healthcare providers, expert medical testimony, medical records and the like are irrelevant. The Court has narrowed the issues by virtue of granting CMS' Motion for Partial Summary Judgment. None of the medical issues in Mr. Valdez' case is now relevant or probative in the remaining portion of the Valdez case. Therefore, Defendant CMS seeks an Order precluding Northland from introducing, mentioning, arguing or otherwise referring to Mr. Valdez' medical condition, care rendered by CMS or other healthcare providers as being irrelevant and,
