North American Specialty Insurance Company ("North American") requests summary adjudication of its pending motion to intervene at the final pretrial conference scheduled for March 3, 2006 at 3:00 p.m. North American seeks to intervene for the sole purpose of submitting special interrogatories or special verdict forms to the jury that would identify the basis of a verdict against its insured, defendant Correctional Medical Services, Inc. ("CMS"), if any. North American's motion was prompted by a recent summary judgment ruling in a pending declaratory judgment lawsuit that no coverage exists for some of the claims against CMS in this lawsuit. North American's motion was filed on February 3, 2006. Responsive memoranda were due on or before February 21, 2006. LRCiv 7.2(c); F.R.Civ.P. 6(a); F.R.Civ.P.
