STATUS REPORT

15 United States Attorney for the District of Arizona, Lisa Roberts, Assistant United States 16 Attorney, of counsel, respectfully files this Status Report with regard to the above action, and 17 pursuant to the Court's Minute Order of August 25, 2006 at docket 181. 18 Learjet 19 As reported in the August 21, 2006 status report filed at docket 179, the defendant 20 Learjet was sold at public auction on June 23, 2006, at the Broward County Convention 21 Center in Fort Lauderdale, Florida, for $4.4 million. On August 25, 2006, EG&G Technical 22 Services, the property manager contracted by U.S. Customs and Border Protection to store, 23 maintain, repair, and sell the defendant Learjet in connection with this action, submitted a 24 breakdown of the expenses incurred in such tasks. A copy of this report was forwarded to all 25 counsel of record in this action on September 11, 2006. Numerous discussions have ensued 26 as requests have been made for further cost details. The government is attempting to gather 27 further cost breakdowns. It is expected that all parties to this litigation will continue to 28

1 confer in an attempt to reach an agreement on the costs to be deducted from the sale of the 2 aircraft according to the directions set forth in this court's order of September 8, 2005. 3 Related Criminal Investigation 4 There has been no further investigation of the parties or incidents that comprise the

5 basis for the instant forfeiture. The government has considered and will continue to consider 6 the Court's suggestion to immunize claimant Alberto Abed Schekaiban, as well as other 7 potential means for moving the forfeiture action forward. 8 Discovery 9 Discovery remains stayed pursuant to the Court's August 24, 2006, order at docket 10 181. The plaintiff United States of America stands ready to recommence discovery 11 proceedings as soon as the stay is lifted. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PAUL K.
