PLAINTIFF and CLAIMANTS, Alberto Abed-Schebaikan, Calezar, Ltd.,

Uptongrove, Ltd., Casafin, Ltd., and Hartslope Holdings, Ltd., (hereinafter "C1aimants"),

hereby respectfully request this Honorable Court enlarge the time to file a response to

Plaintiff’ s Motion to Reconsider the Court’ s Order [Docket No. 94]. This Honorable Court

` has ordered that Defendants file and serve a response by Monday, August 29, 2005.

Defendants request an enlargement of time of 14 days, to and including September 12, 2005,
22
and for good cause show as follows:

1. Counsel Orr is at this time conducting a writ of habeas corpus hearing in In re
24
Mark Zapata, No. 01-CR—3607·-Wl, in the 290th Judicial District Court, San Antonio, Bexar
25
County, Texas. This hearing commenced on August 17, 2005. The State of Texas will be
26
presenting their case on Friday, August 19, 2005. There is an actual innocence claim in this
27

1 case.
_ 2 2. Counsel are preparing for tiling a petition for writ of certiorari to the United States
3 Supreme Court in Sosa v. Dretke, Director, Texas Department of Criminal Justice,
4 Institutional Division, No. _______, due on August 29, 2005. Mr. Pedro Solis Sosa is on Texas
5 death row. The State of Texas is seeking an execution date of October 21, 2005.
6 3. Counsel are preparing for filing a petition for writ of certiorari to the United States
7 Supreme Court in Rana v. U.S., No. _, due on August 23, 2005. Dr. Athar Niaz Rana
8 was convicted of health care fraud.
9 4. Counsel are preparing for a sentencing in U.S. v. Cordero-Ontiveros, Cause No.
10 SA-03-CR-567 RF, in the United States District Court for the Western District of Texas, San
11 Antonio Division, on August 24, 2005. This is a drug case.
12 5. Counsel are scheduled for oral argument at the Fifth Circuit Court of Appeals in
13 U.S. v. Gonzales, No. 04-20131, on August 30, 2005. This is a civil rights case.
14 6. Counsel Orr has a reply to the Governmenfs response to Petitioner’s Motion to
15 Vacate, Set Aside or Correct Sentence and Conviction under 28 U.S.C. §2255 in Smith v.
16 U.S., No. A-05-CA—483-JN, in the United States District Court for the Western District of
17 Texas, Austin Division. This is a drug case.
18 7. Counsel are preparing for a pretrial motions heating in State of Texas v. Smith,
19 Cause No.’s 4226 and 4227, in the 216* Judicial District Court, Kendall County, Boerne,
20 Texas, on September 1, 2005. This is a sexual assault of a minor case and sexual assault I
21 case.
22 8. This motion is not made in order to delay justice but to allow for a fair and just
23 response to Plaintiff s motion to reconsider this Honorable Court’s Order [Docket No. 94].
24 WHEREFORE, PREMISES CONSIDERED, the Defendants pray that this Honorable
25 Court grant this Motion for Enlargement of Time to and including September 12, 2005, and
26 for such other and further relief as this Honorable Court deems just and proper.
