On April 14, 2006, plaintiff and counter-defendant Meritage Homes Corporation and third-party defendants Steven J. Hilton, John R. Landon, and Larry W. Seay (collectively, the "Meritage Parties") filed their motion for interim attorneys' fees and nontaxable costs against defendant and counter-claimant Greg Hancock ("Hancock"). In that motion at 3:19-21, the Meritage Parties inadvertently cited Hancock's Answer to Plaintiff's First Amended Complaint; Counterclaim; Third Party Complaint ("Hancock's First Counterclaim") instead of Hancock's Answer to Plaintiff's Second Amended Complaint; and Counterclaim and Third-Party Complaint ("Hancock's Second Counterclaim"). The statement that is cited in the Motion is identical in both

counterclaims, but the Second Counterclaim is the most recent articulation of Hancock's claims. Accordingly, the cite at 3:19-21 of the Motion should refer to the Second
