Pursuant to Fed. R. Civ. P. 54(d)(1) and LRCiv 54.1(a), plaintiff and counterdefendant Meritage Homes Corporation and third-party defendants Steven J. Hilton, John R. Landon, and Larry W. Seay (collectively, the "Third-Party Defendants") hereby submit their interim Bill of Costs as a result of the Court dismissing the counterclaim and thirdparty complaint brought by defendant, counterclaimant, and third-party plaintiff Greg Hancock ("Hancock"). Attached as Exhibit A hereto in support of this memorandum is the interim Bill of Costs on a form provided by the Clerk as well as supporting documentation of the costs incurred by Meritage Homes and the Third-Party Defendants. As of April 14, 2006, Meritage Homes and the Third-Party Defendants have been forced to spend $9,517.49 in order to successfully defend against Hancock's counterclaim and third-party complaint.
