Rick and Brenda Hancock, Defendants, Counter-Claimants, and Third Party Plaintiffs, v. Meritage Homes Corporation, a Maryland Corporation, formerly d/b/a Meritage Corporation, Hancock-MTH Builders, Inc., an Arizona Corporation, Hancock-MTH Communities, Inc., an Arizona Corporation, an Arizona Corporation; and currently d/b/a Meritage Homes Construction, Inc., an Arizona Corporation, and Meritage Homes of Arizona, Inc., an Arizona Corporation; Steven J. Hilton and Suzanne Hilton, husband and wife; John R. Landon and Debi Landon, husband and wife; Scott Keeffe and Vicky Keeffe, husband and wife; Roger Zetah and Jane Doe Zetah, husband and wife; and James Arneson and Zane Arneson, husband and wife, Third Party Defendants. Defendant Greg Hancock opposes Plaintiffs' request for leave to exceed the page limit on their Response to his Updated Motion for Summary Judgment or Dismissal ("Motion"). This is very illuminating. First, he complains about the length and breadth of the controverting statement of facts, which is simply a reflection of how not well-taken his Motion is in the first place because it is ripe full of disputed facts. More importantly, controverting statement of facts are not subject to a page limit under the Federal Rules of Civil Procedure. This is entirely consistent with the summary judgment scheme, which is intended to require and permit the opposing party to identify any and all facts creating genuine issues of material fact. Second, this is a motion for leave to exceed the page limits for good cause, and Greg Hancock simply ignores the stated reasons for good cause. He does not address the breadth of the facts stated in the Motion and accompanying Statement of Facts. He also does not dispute Meritage's assertion that structure and nature of his Motion forces the lengthy Response because the "Motion consists of paragraphs upon paragraphs of misstatements of law and the factual record, out-of-context or misquoted testimony, and

unsupported assertions." In other words, he has no excuse for his conduct and no rebuttal to the basis for good cause. In this light, good cause to exceed the page limits exists. DATED this 6th day of March, 2007. SNELL & WILMER L.L.P.
