Plaintiffs respectfully ask this Court for permission to file Plaintiffs' Reply Re (1) Plaintiffs' Motion for Partial Summary Judgment, and (2) Counterdefendants' and ThirdParty Defendants' Motion for Summary Judgment on Rick and Brenda Hancocks' Counter-Claims and Third-Party Claims in a number of pages exceeding the presumptive limit of eleven (11) pages pursuant to LRCiv. 7.2(e). The Reply Memorandum exceeds the limit by eight (8) pages. Good cause for leave to exceed exists for the following reasons. First, the Reply Memorandum responds to separate Responses, each setting forth many different arguments. Second, as set forth in the Motion to Strike filed contemporaneously herewith, the Responses and Controverting Statements of Fact contain more than a hundred factual statements that are not in compliance with Fed. R. Civ. P. 56(e) and LRCiv. 56.1(b). As a result, many pages were collectively used to clarify the record. Third, both Responses repeatedly misstated the law, and Meritage used a substantial amount of space to clarify these misstatements.

Meritage is very cognizant of the Court's presumptive limits and limited resources. For the reasons set forth above, it believes that leave is appropriate and will, in fact, reduce the Court's burden in addressing the Motion.
