Plaintiffs file this notice to apprise the Court of an error in Plaintiffs' Response in Opposition to Defendants Rick and Rick and Brenda Hancock, Rick Hancock Homes, Inc., and RLH Development, Inc.'s Renewed Motion for Summary Judgment [Dkt. #436]. On page 7, line 16, the following footnote should have been added after the cite for E. & J. Gallo Winery v. Gallo Cattle Co., 967 F.2d 1280, 1289 (9th Cir. 1992): The only exception is when a defendant's use of his own name was derived independently from the senior user's name and was in good faith. See, e.g., Adray v. Adry-Mart, Inc., 76 F.3d 984, 990-91 (9th Cir. 1995). This circumstance is undisputedly not present here. (See CSOF at ¶¶ 24, 53, 89, and 93-95.)
