Plaintiffs respectfully ask this Court for permission to file Plaintiffs' Reply to (1) Rick Hancock's Response to Meritage's Motion to Strike, and (2) Rick Hancock's Request For Leave to Supplement the Record in a number of pages exceeding the presumptive limit of eleven (11) pages pursuant to LRCiv. 7.2(e). Memorandum exceeds the limit by six (6) pages. Good cause for leave to exceed exists for the following reasons. First, the Reply Memorandum responds to both Rick Hancock's Response to Meritage's Motion to Strike and to Rick Hancock's Request for Leave to Supplement the Record. Second, as set forth in Meritage's Reply filed contemporaneously herewith, the Response contains more than a hundred factual statements that are not in compliance with Fed. R. Civ. P. 56(e) and LRCiv. 56.1(b). As a result, several pages were used to clarify the record. Also, Rick Hancock's Response repeatedly misstates the law, and Meritage uses a substantial amount of space to clarify these misstatements. Meritage is very cognizant of the Court's presumptive limits and limited resources. For the reasons set forth above, it believes that leave is appropriate and will, in fact, The Reply
