The parties jointly move for a continuance of the July 29, 2008 trial date. The parties have met and conferred concerning irreconcilable scheduling conflicts of key witnesses and the parties' trial counsel that have resulted from the resetting of the trial date to July 29, 2008. The parties' counsel respectfully request a continuance of the trial from July 29, 2008 to September 9, 2008, with the pretrial conference to be reset for September 5 or 8, 2008. Alternatively, the parties stipulate that they can be ready to begin trial on August 12, 2008, but Plaintiff's counsel has a conflict that will require STIPULATED MOTION FOR CONTINUANCE OF TRIAL DATE

postponement of the trial during the Labor Day week of September 1, 2008. Counsel will be available to continue with the remainder of the trial on September 9, 2008. The parties further stipulate that the trial can be completed in twelve total trial days, six to seven days for plaintiff's case and five to six days for the defendant's case.
