IT IS FURTHER ORDERED Plaintiff's Motion in Limine re Defendants' Use of Atty-Client Communications (Doc. 571) is GRANTED. Defendants are barred from introducing any evidence or making any argument concerning the documents entitled: "Material Litigation and Miscellaneous Legal Department Status Report as of February 13, 2006" and "Meritage Homes Phoenix Division Quarterly Summary of Legal Activities."

IT IS FURTHER ORDERED Defendants' shall destroy all copies of the above documents. IT IS FURTHER ORDERED the Clerk of the Court shall strike Defendants' Response to Meritage Motion in Limine re: Eileen Carlson (Doc. 566). IT IS FURTHER ORDERED the Clerk of the Court need not seal this Order.
