1 the allegations ofthe complaint, and I am a former participant of the Retirement Plan
2 for Employees of the Garrett Corporation and Its Participating Subsidiaries (and the
3 Severance Plan for Employees of the Gatrett Corporation and Its Participating
4 Subsidiaries who became a vested participant in the Signal Companies Inc. Retirement
5 Plan and the Secured Benefit Account of the Signal Companies, Inc. Savings and
6 Stock Purchase Plan and successor plans.
` 7 4. Although the names ofthe company and division I worked for
_ 8 changed several times throughout my employment, I was always employed in the
l 9 Phoenix area. -
10 5. While I was employed, from time to time I received summary I
11 plan descriptions. After I retired in 1993, I was never sent copies of any updated
12 summary plan descriptions from any ofthe Defendants.
1 3 p 6. Ihave reviewed the communications attached as Exhibits 3, 18
14 andl9 to the Declaration of Craig Chapman. I did not receive a copy of these
15 documents in 1995 or 1996. They were not sent to me by the Company or the Plan.
16 The first time I saw these doctunents was after this lawsuit had been tiled
