Pursuant to Local Rule 54.2(b)(1), Defendants move for an award of their reasonable attorneys' fees and non-taxable expenses incurred in connection with this matter. This lawsuit involves a dispute over plaintiff David Mazet's entitlement to benefits under a group long-term disability plan that is governed by the Employee Retirement Income Security Act of 1974 ("ERISA"), 29 U.S.C. § 1001 et seq. Judgment was entered in Defendants' favor on August 29, 2008 (Doc. #95 and #96). Defendants are entitled to recover their reasonable attorneys' fees and costs incurred pursuant to 29 U.S.C. § 1132(g). Defendants estimate the amount of attorneys' fees and non-taxable costs for which they seek an award total approximately $70,000.00. Defendants will later submit a Memorandum and Supporting Documentation pursuant to Local Rule 54.2(b)(2).
