UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA ) ) Plaintiff, ) ) vs. ) ) Halliburton Company Long-Term Disability ) ) Plan; and, Hartford Life & Accident ) Insurance Company, ) ) Defendants. ) ) David L. Mazet, No. CV 04-00493 PHX-FJM DEFENDANTS' REQUEST FOR LEAVE TO FILE SUPPLEMENTAL BRIEF IN OPPOSITION OF PLAINTIFF'S SUR-RESPONSE

Plaintiff's Sur-Response raises two new issues. Defendants request leave of this Court to file a short explanatory brief. In his Sur-Response, Plaintiff challenges two calculations: (1) the CPI-W percentages; and (2) the estimated median wage calculation. If permitted, defendants will submit a memorandum explaining each calculation. The memorandum will explain that the difference between the parties' CPI percentages. The plan calls for the CPI-W "as of July 31st." See Sur-Response at p. 4 and Docket #78, pg. 3. That is what Hartford used. But Plaintiff used the CPI-W for August 31st. The memorandum will also explain a fundamental difference in calculating estimated median wages. Defendants have used estimated wages of occupations while Plaintiff has used a median wage of an entire occupational category. Plaintiff's occupational matches yield a higher estimated median wage than the average of the entire occupational category.
