The Court is in receipt of Plaintiff's "Notice of Delay on Plaintiff Request for Judgment in the Plaintiffs Favor on the US Mail Issue" (Doc. # 122). Plaintiff requests that this Court grant Plaintiff an additional 4 days to comply with this Court's December 20, 2005 Order requiring Plaintiff to refile his dispositive motion. Plaintiff's request will be stricken as improperly filed, as it does not comply with Local Rule 5.4, which requires that an additional copy of a motion be filed for the Court's use. However, the Court will, sua sponte, grant Plaintiff an additional 10 days from the date of this Order to refile his dispositive motion. Accordingly, IT IS ORDERED THAT Plaintiff's "Notice of Delay on Plaintiff Request for Judgment in the Plaintiffs Favor on the US Mail Issue" (Doc. # 122) is STRICKEN as improperly filed. /// ///
