The Court is in receipt of Plaintiff's Request for Leave to File Motion for Judgment in Plaintiff's Favor on the US Mail Issue (Doc. # 107). This is a Motion for Summary Judgment. Accordingly, IT IS ORDERED THAT the clerk shall adjust the title of the motion of Doc. # 107 to a Motion for Summary Judgment. IT IS FURTHER ORDERED THAT the clerk shall STRIKE the document as improperly filed pursuant to 56.1(a) for failing to separately set forth the specific facts relied upon in support of Plaintiff's motion for judgment. Plaintiff may refile his motion in conformity with Local Rule 56.1(a) within 20 days of the filing of this order.
