Plaintiff requested additional time to respond to Defendant Lizarraga's Motion to Dismiss (Doc. # 101). On December 5, 2005 the Court granted Plaintiff's request and ordered him to respond to Defendant Lizarraga's Motion to Dismiss by January 6, 2006. On December 23, 2006, Plaintiff filed two Responses to Defendant Lizarraga's Motion (Docs. ## 115, 116). Subsequently on January 5, 2006, Plaintiff filed an additional Response to Defendant Lizarraga's Motion to Dismiss (Doc. # 120). However, this Response was docketed as a motion. On January 26, 2006, Defendant Lizarraga filed a Reply to his Motion to Dismiss and for Judgment on the Pleadings (Doc. # 126).

IT IS ORDERED withdrawing the reference to the Magistrate Judge as to Defendant Dr. Lizarraga's Motion to Dismiss Case and for Judgment on the Pleadings (Doc. # 86) and Plaintiff's "Motion to Reject Defendants Request to Dismiss Case" (Doc. # 120).
