Before the Court is Plaintiff's "Notice and Advising Notice" and "Notice Clearification [sic]" filed September 23, 2005. In the later document, Plaintiff repeats claims related to writing materials, and asks the Clerk to run copies of documents for him. In the former document, Plaintiff reiterates his writing materials claims, as well as discusses his pending state court case, his blood sugar, and his fear of being at the jail. As to Plaintiff's writing materials and copying, the Court resolved these issues in its September 21, 2005 Order. As to other averments not related to the claims contained in the Amended Complaint, Plaintiff has been advised on prior occasion that such averments are improperly made unless Plaintiff seeks to amend the Amended Complaint. Because the Court has advised Plaintiff on prior occasion that repeated frivolous filings will result in the Court requiring Plaintiff to seek leave of Court before filing any document, the Court will do so now. IT IS ORDERED that: 1. Plaintiff must seek leave of Court before filing any future document or motion in this case. That is, Plaintiff may not make any substantive averment to the Court unless he first files a motion that requests permission to file a document or motion. The request must be captioned as follows: "Motion for Leave to File Motion/Document." The request must explain to the Court the reason why Plaintiff must file a motion or document. No substantive motion or document may be filed until the Court has granted leave to do so. 2. Failure to follow the Court's Order as explained herein shall result in any document or motion being summarily stricken as improperly filed. DATED this 28th day of September, 2005.
