ORDER
Before the Court is Defendants' Response to Plaintiff's Motion/Request for Court

Order to Receive Legal Civil Court Papers and Legal Mail" (Doc. # 67) and Plaintiff's
17
response thereto (Doc. # 74). Defendants response was filed in response to the Court's
18
August 17, 2005 Order (Doc. # 59), in which the Court ordered Defendants to
19
investigate Plaintiff's claims that he is not receiving his legal paperwork or writing
20
materials. Defendants state to the Court that Plaintiff is receiving writing materials, as
21
evidenced by Plaintiff's several, recent motions filed with the Court. Defendants further
22
state that Pinal County policy is that Plaintiff may only receive his mail through the jail
23
mail system, not through his sister.

The Court finds that Plaintiff has demonstrated that he has access to writing
25
materials, as evidenced by his numerous, recent filings in the case. Further, it is not
26
unreasonable, for security reasons, for Pinal County to require that legal mail be
27
properly forwarded to the jail, and not hand-delivered. Therefore, the Court considers
28
Plaintiff's claims regarding writing materials and legal mail resolved. No further motions

regarding such claims shall be filed by Plaintiff without Plaintiff first seeking leave of Court to do so. IT IS SO ORDERED. DATED this 23rd day of September, 2005.
